BotGauge Terms & Conditions

Last updated: October 28, 2026

01Welcome to BotGauge

These terms are an agreement between you and BotGauge AI Inc., a Delaware company located at 1111B S Governors Ave # 98032, Dover, DE 19904 ("BotGauge", "we", "us"). They cover your use of BotGauge, which helps you observe, test, evaluate and red-team your AI agents.

By creating an account or using BotGauge, you agree to these terms, including our Data Processing Agreement, and acknowledge that you have read our Privacy Policy.

If you're signing up on behalf of a company, you confirm that you're authorised to accept these terms on its behalf. In that case, "you" refers to both you and the company.

If you have any questions, or aren't sure whether these terms suit how you plan to use BotGauge, we encourage you to check your company's policies or contact us at support@botgauge.com before going ahead. We're happy to help.

02Who can use BotGauge

BotGauge is built for teams and professionals who build and run AI agents, from independent developers and freelancers to large companies. To use it, you must be at least 18 years old and using BotGauge for your work or business, not for personal or household purposes.

Whether you're trying BotGauge out, testing a prototype or running it across your company, you're welcome to use it under these terms.

You're responsible for your account. Please:

  • Give us accurate sign-up details and keep them up to date.
  • Keep your login details and API keys private, and don't share your account.
  • Tell us right away if you think someone has accessed your account without permission.

You're responsible for everything that happens under your account, including anything your teammates do.

Where BotGauge is offered. BotGauge isn't currently offered in the European Economic Area, the United Kingdom, Switzerland, Brazil, China, South Korea, Russia or Belarus, or in countries under comprehensive US sanctions (Cuba, Iran, North Korea and Syria). Please don't create an account from these places, or on behalf of someone located in them. We may refuse or close accounts that do.

03Changes to BotGauge

We're actively building BotGauge, so features, usage limits and what's included may change, and some features may be removed. Some features may be marked as beta, which means they're still being tested and may not work perfectly.

The usage limits for your account are shown in the product. Some plans or features may come with additional terms. If so, we'll show you those terms and ask you to accept them before they apply.

04Your data

Your data is yours. That includes the traces, prompts, responses, test results and reports you create on BotGauge. We never sell it, and we don't share it with other customers.

How we use it. We use your data only to run BotGauge for you: to run your tests, show your results and help you when you contact support.

Where it goes. We store your data securely and share it only with the few trusted providers we rely on to run the service, such as our cloud hosting and AI model providers. They can use it only to help us deliver BotGauge to you, and they're bound to keep it confidential. We list them at botgauge.com/legal/subprocessors, and we give 30 days' notice before adding one.

No training on your data. We don't use your data to train AI models, and we don't use it to build tests or attacks for other customers. If we ever want to, we'll ask first, and it stays off unless you turn it on.

Usage stats. We do look at general usage information, like how often features are used, how long things take and when errors happen. This never includes the content of your prompts, responses or tests, and we use it only to keep BotGauge running well and to improve it. To opt out, email privacy@botgauge.com. Our Privacy Policy explains what's collected.

How long we keep it. We keep your test content for your plan's retention period, shown in your project settings, after which it's deleted automatically. You can delete your projects, workspaces or organisation at any time. To delete your personal account, email us at privacy@botgauge.com. Deleted items can be restored for 14 days, in case of mistakes, and are permanently deleted within 30 days. Backup copies are overwritten within a further 7 days.

Sensitive data. Don't send us health records, payment card details, government ID numbers or other highly sensitive data. If your agent handles real people's data, you're responsible for having the right to use it for testing and monitoring, and for telling those people what they need to know.

When your data includes personal information, our Data Processing Agreement applies and forms part of these terms. Our Privacy Policy explains how we handle the personal details you give us, such as your name and email.

05Testing your AI agents responsibly

BotGauge tests AI agents by sending them tricky, adversarial prompts, the same kind a real attacker might use. That's what makes it useful, but it also means you need to use it carefully.

Only test what you're allowed to test. You may only point BotGauge at AI agents and systems that you own, or that you have written permission to test. This includes permission from any company that hosts or runs the agent for you, where needed. By adding an agent, you confirm you have this permission.

You're responsible for what your agent does. During a test, your agent might take real actions, like issuing a refund, sending an email, making a booking or changing data. You're responsible for those actions and for cleaning up after them. We strongly recommend testing in a sandbox or test environment, not on a live system.

You control the load. You decide how hard and how often your agent is tested. If a test slows down your agent or triggers limits with your own providers, that's a normal risk of testing.

Expect uncomfortable content. To find weaknesses, tests may generate offensive, harmful or misleading prompts and responses. This content is created only for testing. Please use it only to improve your own agent, and don't share it or use it against anyone else.

We may pause or stop a test at any time, for example if we receive a complaint that a test is aimed at a system it shouldn't be.

06What you can't do

When using BotGauge, please don't:

  • Test any system you don't own or don't have permission to test.
  • Use BotGauge to attack, overload or disrupt anyone else's systems.
  • Use test results or generated content to harm, harass or deceive people.
  • Break the law, or help anyone else break it.
  • Try to hack, probe or bypass the security of BotGauge itself.
  • Copy, reverse-engineer or resell BotGauge, use it to build a competing product, or use its attacks, prompts or results to build or sell attack datasets or tools.
  • Scrape BotGauge or access it with bots, other than through the tools and APIs we provide.
  • Upload viruses or other harmful code.

If you break these rules, we may suspend or close your account.

07Our platform and your feedback

BotGauge, including its software, design, tests, attack techniques and scoring methods, belongs to us. These terms give you permission to use it for your own business while you have an account. They don't give you ownership of any part of it, or the right to use our name or logo.

We love hearing ideas for making BotGauge better. If you send us feedback or suggestions, we're free to use them without owing you anything. We won't name you as the source without asking.

08Results and what we don't guarantee

BotGauge helps you find problems in your AI agents, but it can't find all of them. AI agents can answer differently each time, and tests can only cover so much.

That means:

  • A passing test doesn't mean your agent is safe. Results show what we found, not proof that nothing else is wrong.
  • Scores and findings are automated. They're produced by AI and can be wrong, so please review them before acting on them.
  • Results aren't certification or advice. They don't certify your agent as safe, secure or compliant, and they aren't legal or compliance advice. Decisions about releasing your agent are yours.

BotGauge is provided "as is" and "as available". We work hard to keep BotGauge running smoothly, but we can't promise it will always be available, error-free or suited to your particular needs. To the extent the law allows, we don't give any other promises or warranties about BotGauge.

09Limits on liability

Our total liability to you for any claims about BotGauge or these terms is limited to the greater of USD 100 or the amount you paid us in the 12 months before the claim.

We're also not liable for indirect losses, such as lost profits, lost revenue, lost data, business interruption or damage to reputation, even if we were told they might happen.

In return, you agree to cover our costs, including reasonable legal fees, if someone else makes a claim against us because of:

  • A system you tested without permission.
  • Actions your agent took during a test.
  • Data you sent to BotGauge.
  • Your breaking these terms or the law.

Some places don't allow these kinds of limits. Where that's the case, they apply only as far as the law allows.

10Closing your account

You can stop using BotGauge at any time, and ask us to delete your account by emailing privacy@botgauge.com.

We may suspend or close your account if you break these terms, if your use puts BotGauge, our other users or anyone else at risk, or if the law requires it. Where we can, we'll tell you first and give you a chance to fix the problem.

When an account is closed, your data is deleted as described in section 4. Sections that by their nature should carry on, such as ownership, limits on liability and how disputes are resolved, still apply.

11Changes, disputes and contact

Changes to these terms. We may update these terms as BotGauge grows. If we make an important change, we'll let you know by email or in the product at least 30 days before it takes effect, unless the change is needed for legal or security reasons. If you keep using BotGauge after that, you're agreeing to the new terms. If you don't agree, you can stop using BotGauge and ask us to delete your account by emailing privacy@botgauge.com.

Governing law. These terms are governed by the laws of the State of Delaware, USA.

Disputes. If something goes wrong, please contact us first. We'll try to sort it out together. If we can't resolve it within 30 days, the dispute will be settled by binding individual arbitration under the JAMS rules, held in Delaware or online. Neither of us will bring or join a class or group action. Either of us can still go to court for urgent relief or to protect intellectual property.

The rest. These terms, our Data Processing Agreement and any additional terms you accept under section 3 are the whole agreement between us about BotGauge. If part of these terms can't be enforced, the rest still applies. If we don't enforce a term right away, we can still enforce it later. You can't transfer these terms to someone else without our permission, but we may transfer them if BotGauge is merged or acquired.

Notices. We'll send notices to the email address on your account.

Events outside our control. We're not responsible for delays or failures caused by events beyond our reasonable control, such as natural disasters, outages at our providers or cyber attacks.

Export rules. You must follow US export and sanctions laws when using BotGauge. You can't use BotGauge if you're subject to US sanctions or located in a country or region under comprehensive US sanctions, or on behalf of someone who is.
